Sistemas Aéreos Especializados S.L offers a variety of tours, tickets and services (“Products”) through its website www.skytourbcn.com.
These terms and conditions define the basis on which bookings are accepted and contain legal obligations; therefore, please read the Terms carefully before using this website.

By using this website, you agree to be bound by these Terms; if you do not agree with all of the Terms, you must not use this website. Any change to these terms shall not take effect unless it is in writing and authorized by Sistemas Aéreos Especializados S.L.

Sistemas Aéreos Especializados S.L may unilaterally modify the terms and conditions set out herein, in whole or in part. Any change will appear in the same form as set out in this legal notice. It is your responsibility to read them periodically, as the terms in force at the time of using the website or entering into the contract (as defined later in this document) will be the applicable ones.

By using this website and making bookings through it, you agree to:
Use this website only to make legally valid inquiries or bookings.
Not make any false or fraudulent booking. If such a booking can reasonably be considered to have been made, we will have the right to cancel it and inform the relevant authorities.
Provide your email address, postal address and/or other contact details accurately and truthfully. You also agree that we may use this information to contact you if necessary. Please see our Privacy Policy.
If you do not provide all the information we need, we cannot process your booking.
By making a booking through this website, you declare that you are over 18 years of age and have the legal capacity to enter into a contract.

GENERAL TERMS OF CONTRACT AND SERVICE PROVISION

Flight time confirmation

The exact time of the experience will be communicated to the client the day before the flight by email, phone, or WhatsApp provided by the client.

The times requested by the client will be indicative only and will always be subject to operational availability, weather conditions, airport restrictions, and flight planning.

SkyTourBCN may modify the originally scheduled time for these reasons, which may result in a variation in the planned schedule, without giving rise to any right to cancellation, refund, or compensation.

Passenger weight and distribution

For strictly operational and air safety reasons, all passengers must accurately report their actual weight before the flight.

Concealment, falsification, or significant error in the reported weight may result in:

Denial of boarding;
Modification of passenger distribution;
Payment for additional seats;
Or cancellation of the booking without right to a refund.

Weight and capacity limitations

Robinson R44 helicopter or similar

Maximum capacity: 3 passengers + pilot.
Passengers weighing more than 110 kg must book and pay for two seats.
Passengers weighing more than 130 kg may not fly in the R44 model due to the technical certification of the seats.

AS355 helicopter or similar

Approximate maximum capacity: between 5 and 6 passengers + pilot, depending on the total weight of the group.
Passengers weighing more than 110 kg must book and pay for two seats.
Passengers weighing more than 150 kg may not fly in the AS355 model due to the technical certification of the seats.

In case of special circumstances, SkyTourBCN may propose alternative solutions subject to availability.

Safety during the operation

For operational safety reasons:

It is not permitted to carry loose items during the flight such as scarves, caps, selfie sticks, camera poles, or other items that could compromise safety.
All electronic devices must remain in airplane mode for the entire duration of the experience.
Passengers must follow the pilot’s and ground staff’s instructions at all times.

SkyTourBCN may deny boarding to any person who fails to comply with safety rules, without right to a refund.

Weather and operational conditions

Flights are subject to favorable weather conditions, operational authorizations, and the technical availability of the aircraft.

SkyTourBCN reserves the right to cancel, delay, or reschedule flights for reasons including:

Adverse weather;
Low visibility;
Strong wind;
Airport restrictions;
Technical reasons;
Or any circumstance affecting the safety of the operation.

In the event of cancellation for these reasons, the client may choose between:

Rescheduling the experience for another available date; or
Requesting a full refund of the amount paid.

No additional costs arising from travel, accommodation, external bookings, or other indirect costs caused by flight modifications or cancellations will be assumed.

Changes and cancellations by the client

Date changes and cancellations will only be accepted when communicated at least 24 hours in advance of the flight time confirmed by SkyTourBCN.

Once the flight time has been officially communicated:

No cancellations will be accepted;
No modifications will be accepted;
And the client’s failure to show up (“no show”) will result in the loss of 100% of the amount paid.

Right of withdrawal

In accordance with the provisions of Article 103.l) of Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Protection of Consumers and Users, the right of withdrawal does not apply to bookings for tourist flights, aerial experiences, or other leisure activities contracted through this website when the contract provides for a specific date or period of performance.

Consequently, once the booking has been made, the client may not exercise the right of withdrawal generally provided for distance purchases, with only the modification and cancellation conditions set out in these General Terms of Contract being applicable.

In the case of gift vouchers or experiences with no set date, the exercise of the right of withdrawal will be governed by the consumer regulations in force at any given time.

Punctuality and check-in

Passengers must arrive at the facilities at least 20 minutes before the indicated time.

A delay by the client may result in the cancellation of the experience without right to a refund if it affects the planned operation.

Audio guide

Some flight experiences may include, at no additional cost to the client, a complementary premium audio guide service for the sole purpose of enhancing the experience during the tour.

The availability and proper functioning of this service are not guaranteed and may be affected by technical issues, coverage, connectivity, mobile device compatibility, battery, interference, or other operational circumstances beyond SkyTourBCN’s control.

The inability to use, interruption of, or incorrect functioning of the audio guide will not affect the main service contracted, consisting of the tourist helicopter flight, and will not give rise to any right to a refund, financial compensation, or claim of any kind by the client.

The use of the audio guide is optional and subject to technical availability on each flight.

Right of admission and operational safety

SkyTourBCN reserves the right of admission and may deny boarding to any passenger who:

Is under the influence of alcohol or narcotic substances;
Behaves inappropriately;
Poses a risk to the safety of the operation;
Or fails to comply with staff instructions.

In these cases, there will be no right to a refund.

Minors

Minors must travel accompanied by their father, mother, or legal guardian, or have the corresponding authorization where applicable. The minimum age to participate in the experience is 2 years.

People with reduced mobility or special needs

Clients who require special assistance, have reduced mobility, or have any condition that may affect the safe performance of the experience must inform SkyTourBCN in advance so that operational feasibility can be assessed and, where appropriate, suitable measures adopted.

Liability

SkyTourBCN operates in accordance with current aeronautical regulations and holds the necessary authorizations and mandatory insurance for carrying out aerial work and tourist flights.

SkyTourBCN’s liability shall be limited to the cases legally provided for and to the coverage of the applicable mandatory insurance.

Acceptance of terms

Booking any experience implies full acceptance of these general terms.

Minimum number of passengers

To confirm a flight, we always reserve a minimum of 2 passengers per flight for Robinson R44 or similar models, and 5 for AS355 or similar models. If you wish to book for 1/2/3/4 passengers, the company will try to find the remaining passengers in order to reach the minimum number required depending on the helicopter model.
If you wish to fly alone (exclusive flight), you will need to book a flight for 3 passengers on Robinson R44 or similar models, and 5 passengers on AS355 or similar models.

Payments

Payments may be made using the methods enabled on the website at the time of booking. The full amount must be paid to confirm the booking.

Liability

Users of this website and its services must use them in accordance with current legislation, good faith, and generally accepted standards of use, refraining from carrying out unlawful activities or activities that could harm the rights and interests of third parties or affect the normal operation of the website. Failure to comply with these obligations may give rise to any legally applicable liability.

Sistemas Aéreos Especializados S.L. does not guarantee uninterrupted availability of the website, although it will take reasonable measures to ensure its proper functioning. Where possible, scheduled interruptions will be announced in advance.
